If you are living with, or are married to, an Australian citizen, permanent resident or eligible New Zealand citizen, these visas may be the solution for you to migrate to Australia.

These visas allow the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to either:

(a) migrate to Australia to be with their partner; or

(b) to remain in Australia with their partner (if the visa was applied for from inside Australia).

The basis for these visas is either a de facto relationship or a married relationship.

Depending on your circumstances, the process can lead to the grant of a permanent partner visa on approval of the initial application, or it can be a two stage process.

The two stage process involves a provisional partner visa stage and the permanent partner visa stage. At the moment, the initial application covers both stages of the process, but if the second stage is required, you will need to complete a permanent partner visa assessment two years after the initial application.

That assessment will need to demonstrate that your relationship is still genuine and ongoing and that you continue to live together (or only live apart on a temporary basis).
